General Terms and Conditions

These General Terms and Conditions - hereinafter: "Terms and Conditions" - govern the conditions for using the service provided by Dekany's Limited - hereinafter: "Service Provider" - through the himzoshop.hu website - hereinafter: "Service".


1. General information

By placing an order in the himzoshop.hu web store operated by Dekany's Limited (hereinafter referred to as the "Web Store"), the customer declares that he or she have understood and accepts these terms and conditions.

This contract is valid for an indefinite period from the date of acceptance, and its scope extends to the electronic commerce service provided in Hungary and Europe, which is carried out through the Web Store operated by Dekany's Limited.

5. Description of the service

Through the website himzoshop.hu, the Service Provider makes clothing, clothing and textile accessories for the Customers with unique embroidery patterns, as well as customized patterns specified by the Customer.


6/A. Order process and conditions of purchase

By viewing the Web Store, registering, and making a purchase (or any of these), a contract is created between the Web Store and the Customer in accordance with these General Terms and Conditions.

  • In the case of clothing products, the Customer must choose size, color and type.
  • The quantity to be ordered can be entered in the "Unit" field.
  • For some products, the "Comments" section must also be filled out.

By clicking the "Add to cart" button next to the selected product, you can place the product you want to order in the cart.

You can view the contents of the cart by clicking the "Cart" button in the upper right menu. At this time, it is also possible for the Customer to change the quantity of products placed in the basket, or remove from the cart.

The delivery methods indicated on the website are FREE for delivery within the territory of Hungary.

However, it is possible to deliver within the entire territory of Europe, for which the Service Provider charges postage:

  • In case of delivery of 1-2 products abroad, the cost is HUF 7,000-11,000 or more (MPL prices).

In the case of an order number greater than 1-2, it is recommended that the Customer contact the Service Provider in order to calculate the total amount.

After choosing the delivery method and completing the purchase, the system automatically calculates the amount to be paid. You can then complete your purchase by clicking the "Payment" button at the bottom of the page.

After logging in, it is also possible to track orders. After entering the Web Store, you can check the status of your already sent orders by clicking the "My Orders" button.

After placing the order, the online store's system will automatically notify the Customer via e-mail about the status of the Customer's order. The confirmation e-mail contains all the information related to the order. The system sends an additional automatic message if the Service Provider has handed over the package to the courier.


6/B. Processing orders

Orders are processed by the Service Provider within 24 hours.

The products selected from the designs in the Web Store will be delivered to the address specified by the Customer within 10-12-15 business days after placing the order.

6/C. Ordering CUSTOM EMBROIDERIES - Based on your own image/design

Ordering individual embroideries begins with a price calculated based on the image/design sent by the Customer. If the Customer accepts the price offer, the Service Provider will only start processing the order after receiving the payment.

The Service Provider then prepares a visual design of the custom design on the chosen piece of clothing, the cost of which is included in the total amount of the order.

The Service Provider then digitally redraws the design with a separate software, and then digitizes the drawn pattern with another software so that the embroidery machine can sew the unique pattern.

Depending on the complexity and size of the design, this process takes about 4-6 days, so the finished package is usually delivered to the address specified by the Customer within 10-12-15 business days from the time the order is placed.

The Service Provider reserves the right to take more time to prepare the order if:

- The Customer requests changes
- The Customer does not respond in time to the emails sent by the Service Provider
- Clothes are sent with an unexpected delay in wholesalers
- There is a shortage of stock in wholesalers.


If the number of items of the "Custom embroidery" order
is between 2-5, the Service Provider offers the possibility of a test embroidery in addition to the visual design, so that the Customer can make sure that the quality of the embroidery and the overall appearance of the chosen product is sufficient. In this case, the final order fulfillment time is 8-12 business days, but no more than 30 days.

If the number of pieces of the "Custom embroidery" order exceeds 5 pieces, the Service Provider will always discuss the expected delivery time with the Customer.

7. Shipping Information

Optional delivery methods:

  • MPL home delivery

Delivery within Hungary is free, parcels are delivered by MPL. The delivery person of the MPL courier service, if the first delivery is unsuccessful, leaves a notification for the Customer and then delivers the package again on the next business day.

In the case of deliveries to Europe, the Service Provider will notify the Customer by e-mail and by phone about the progress and status of the delivery.

Package tracking: as soon as the package has been handed over to the courier service, MPL will send the Customer an e-mail about the package's dispatch, as well as an SMS on the day of delivery, which will include the courier's number.

 

8. Payment methods

The Customer must pay in advance in a lump sum.

We would like to draw your attention to the fact that the Web Store does not allow a cash on delivery option for "individual embroidery" orders, due to the products being maximally customized for the Customer.

Depending on the selected product order, the Customer can choose from several payment methods:

Bank card payment - Stripe
The secure bank card payment interface of the Web Store is provided by Stripe.

Bank Transfer
The Customer can pay the amount of the order in HUF - HUF to the following account number:
  • Bank account name (company): Dekanys

EUR - In Euro currency:

We recommend PayPal payment if the Customer has a PayPal account. In this case, the amount must be transferred to:

9. Product purchase price

In all cases, the purchase price of the product is the gross price indicated next to the product (excluding VAT, in this case the VAT is 0%).

The purchase price of "custom embroidery" made for the Customer is determined by the Service Provider depending on the size and number of stitches of the sample.

The indicated prices are in HUF and include VAT (0%).
Promotional prices are valid until withdrawn or while stocks last.

10. Data modification

If the Customer is registered, after logging in, the Customer's data can be changed by clicking on the "Account/Account data modification" button.

11. Correction of data entry errors

At any stage of the order, before the order is sent, the Customer has the opportunity to correct data entry errors on the Web Store interface at any time.

12. Forgot password

By clicking the "Forgot Password" button, our system will immediately send your new password to the specified e-mail address.

13./1. Sizing

During the Christmas period (from October 24, 2022 to December 31, 2022) , due to an extremely high number of orders, it is not possible to change the size for free, only against payment of the full purchase price again.

13./2. The right of withdrawal

The cost of a visual design

The Service Provider reserves the right that the Service Provider cannot refund the full amount if the Customer cancels the order after the visual design has already been made and several changes were requested for the order placed by the Customer.

In this case, the cost of the visual design will be deducted from the total cost of the order, and the reduced amount will be refunded to the Customer.

Visual design + Digital drawing + Embroidery file cost

If the Customer cancels the order with a custom image and/or caption after the digitalized files of the Visual Designs and Embroidery have already been prepared by the Service Provider, the cost of the already provided services will be deducted from the total cost of the order and that reduced amount will be refunded to the Customer.

Complete garment with completed embroidery

Based on the Government Decree No. 45/2014. on detailed rules regarding contracts between consumers and businesses, the Customer has the right of withdrawal (right to return the product, return guarantee) in the case of online purchases.

In accordance with the government decree, the Customer may cancel the purchase within 14 days from the date of receipt of the product without reason, if the product is not "custom embroidery".

In case of cancellation in writing, if the consumer's statement is sent before the end of the deadline, it is considered validated.

The amount paid by the consumer must be refunded by the Owner of the Web Store no later than 30 days after the cancellation. The shipping cost of returning the product is borne by the Customer.

The consumer may not exercise their right of withdrawal after the completion of the service in full, if the Service Provider has started the performance with the prior consent of the consumer and the consumer has acknowledged that the consumer will lose their right to cancel after the completion of the service in full.

Furthermore, the service of the online store:

  • Production of individually embroidered souvenirs, t-shirts, canvas bags, towels - based on the unique request of the Customer and the photos or requested text provided by the Customer;
  • Computer digitized custom file designed for the Customer.

In these cases, if the exercise of the right of withdrawal is ensured, the item would become economically worthless, since it would no longer be possible to sell this unique product to another customer, which has value only to the customer who ordered it, was produced at that specific customer's request, and is tied to that specific person.

[Government Decree 29, section 1, point c]. The Customer may not exercise their right of withdrawal:

  • In the case of a non-pre-manufactured product, which was produced on the basis of the Customer's instructions or at the express request of the Customer (e.g. production of a unique sample / embroidered T-shirt, bag, etc.);
  • In the case of a product that is tied to the person of the Customer or has been produced in a customized manner based on the Customer's unique instructions (characteristics, color, size, material, decoration, etc. provided by the Customer);
  • In the case of a product that, for reasons of health protection or hygiene, cannot be returned after being opened after delivery. 

For hygiene and health reasons, the Service Provider will only take back clothing, mask and towel products if the product can be proven not to have been used by the Customer, i.e. its packaging is unopened and undamaged.

14. Issue of an invoice

The Service Provider issues an invoice for purchases on the himzoshop.hu website, which can be downloaded as an e-invoice for the e-mail address provided by the Customer.

15. Data management

Only the Service Provider can access the personal data provided by the Customer.

The protection of the Customer's personal data is of utmost importance to himzoshop.hu and its partners. The collection and processing of personal data necessary for identification while using the online store complies with the applicable Hungarian data protection regulations (Act CXII of 2011).

We treat the Customer's data confidentially and do not pass it on to third parties - unless it is essential for the fulfillment of the contract (e.g. courier service). Our employees, partners and service providers owe the Service Provider a duty of confidentiality.

15. Language
The language of the Web Store and the conclusion of the contract is Hungarian or English.
